The terms and conditions of sale (the "Terms and Conditions of Sale" or "T&Cs") apply exclusively to the online sale of services offered by the Operator on the website. The T&Cs are made available to customers on the Site, where they can be directly consulted and can also be communicated to them upon request by any means. The T&Cs are binding on the Customer who acknowledges, by checking a box or clicking on the button provided for this purpose, having read and accepted them before placing an order. The validation of the order by its confirmation constitutes acceptance by the buyer of the T&Cs in force on the day of the order, the preservation and reproduction of which are ensured by the Operator.
The Site is an automatic booking service for Too Good To Go application products (hereinafter the "Product(s)"), open to any natural or legal person using the Site (the "Customer"). The Products presented on the Site each have a description mentioning their essential characteristics. The photographs illustrating the services do not constitute a contractual document. The Customer is responsible for the methods and consequences of their access to the Site, particularly via the Internet. Furthermore, the Customer must provide and be entirely responsible for the equipment necessary to connect to the Site. The Customer acknowledges having verified that the computer configuration they use is secure and in working order.
To place an order on the Site, the Customer must create a personal customer account. Once created, to access it, the Customer must identify themselves using their identifier and secret, personal, and confidential password. It is the Customer's responsibility not to communicate their identifier and password in accordance with the provisions of the "Personal Data" article of these T&Cs. Each Customer undertakes to maintain strict confidentiality of this data, acknowledging being solely responsible for access to the Service through their identifier and password, except in case of proven fraud. The Customer undertakes during registration to: provide real, accurate, and up-to-date information at the time of entry in the service registration form, and in particular not to use false names or addresses, or names or addresses without authorization. They also undertake to keep registration data up to date to permanently guarantee their real, accurate, and current nature. In case of non-compliance with these commitments, the Operator reserves the right to suspend or terminate the Customer's access to the Site at their exclusive fault.
The Operator strives to ensure optimal availability of its Products. Product offers are valid while stocks last. If a previously mentioned Product becomes unavailable after the order, the Operator is not The delivery of a Product of equivalent quality and price to that initially ordered. The refund of the Product price ordered no later than thirty (30) days from the payment of amounts already paid. It is agreed that apart from the refund of the unavailable Product price, if this option is requested by the Customer, the Operator is not liable for any cancellation compensation. The Customer must verify the details of their order, its total price, and confirm the delivery and withdrawal terms before proceeding with payment. Order confirmation entails acceptance of the T&Cs and forms the contract. A copy of these T&Cs as accepted by the Customer will be sent by email with the order confirmation. The Operator is in no way responsible for the result obtained with the use of a Product. If said Customer encounters a malfunction of Too Good To Go offers, it is up to them to turn directly to the application and/or merchant. The Operator is responsible only and exclusively for the functioning of a previously mentioned Product.
The Customer expressly acknowledges that any order placed on the Site is an order with payment obligation, which requires payment of a price in exchange for the ordered Product. Payment by credit card is authorized. Payment is secured by Stripe and the Customer's banking details do not transit through the Site. Information is protected by SSL (Secure Socket Layer) encryption. The order is validated upon acceptance of payment by the Customer's bank. In case of payment rejection, the order will be cancelled.
Product prices are indicated in euros (EUR), all taxes included (VAT), excluding delivery and shipping costs. In case of promotion, Magic Bag Tracker commits to apply the promotional price to any order placed during the promotion period. The price is payable in full after order confirmation. If delivery charges apply, they will be added to the price and will appear separately during order validation. The payment of a Product price is always expressed in "Subscription" format valid for thirty days (30 days) with automatic renewal. It is the Customer's responsibility to indicate their wish to interrupt their current subscription.
The contract is formed when the Customer validates their order after completing the required information and clicking on "Pay". The click and payment validation constitute an electronic signature, equivalent to a handwritten signature, and represents an irrevocable acceptance of the order by the Customer. The archiving of purchase orders and invoices is ensured by the Operator on a reliable and durable medium, and may serve as proof in case of dispute.
The Operator remains the exclusive owner of the ordered Products until full payment is received.
Products are delivered to the address indicated by the Customer during the order. It is the Customer's responsibility to provide correct and complete information. Magic Bag Tracker cannot be held responsible in case of delay or impossibility of delivery resulting from errors in the information provided by the Customer.
The Customer has fourteen (14) days to exercise their right of withdrawal, from the validation of their Product order.

By validating their order, the Customer acknowledges having read, understood, and accepted these T&Cs, which constitute a binding agreement between the Customer and the Operator.
